Terms of Service

These Terms of Service ("Terms") govern your access to and use of the loc8n Geographic Data API and related services ("Service") operated by gener8v ("we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account, obtaining an API key, or otherwise accessing the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of Service

loc8n provides a REST API and related tools for accessing U.S. geographic data, including but not limited to ZIP code lookups, Census demographics, boundary geometries, geocoding, employment statistics, mortgage lending data, fair market rents, and migration flows. Data is sourced from public government datasets including the U.S. Census Bureau, HUD, HMDA, IRS, and LEHD.

3. Accounts and API Keys

You must create an account and obtain an API key to access the Service. You are responsible for maintaining the confidentiality of your API key and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use.

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe pose a security risk.

4. Permitted Use

You may use the Service for lawful purposes, including:

  • Building applications that consume geographic data
  • Research, analysis, and visualization
  • Integration with AI assistants via our MCP server
  • Commercial products and services, subject to your subscription tier

5. Prohibited Use

You agree not to:

  • Use the Service to identify, target, or discriminate against individuals based on protected characteristics
  • Attempt to re-identify individuals from aggregate data
  • Circumvent rate limits, authentication, or access controls
  • Redistribute raw bulk data as a competing data service
  • Use the Service in any way that violates applicable law or regulation
  • Share, publish, or transfer your API key to unauthorized parties
  • Interfere with or disrupt the integrity or performance of the Service

6. Subscription Tiers and Billing

The Service is offered under multiple subscription tiers, each with defined request quotas, rate limits, and feature access. Tier details and pricing are available on our Pricing page.

Paid subscriptions are billed monthly via Stripe. You may upgrade, downgrade, or cancel your subscription at any time. Downgrades and cancellations take effect at the end of the current billing period. Refunds are not provided for partial billing periods.

7. Rate Limits and Quotas

Each tier includes defined rate limits and monthly request quotas. Exceeding these limits may result in throttled or rejected requests. We reserve the right to adjust rate limits to maintain service quality.

8. Data Sources and Accuracy

Data provided through the Service is sourced from publicly available U.S. government datasets. While we make reasonable efforts to ensure accuracy and timeliness, we do not guarantee that data is error-free, complete, or current. Government source data may be revised or corrected after publication.

The Service should not be used as the sole basis for decisions with legal, financial, or safety implications. Users are responsible for independently verifying data for critical applications.

9. Intellectual Property

The underlying government data accessed through the Service is in the public domain. Our API, documentation, user interface, software, and branding are the intellectual property of gener8v and are protected by applicable laws.

You retain ownership of any applications, analysis, or derivative works you create using data obtained through the Service.

10. Privacy

We collect account information (email, name) and usage data (API requests, timestamps) necessary to operate and improve the Service. We do not sell personal information to third parties. API request logs are retained for billing, security, and debugging purposes.

Authentication is provided through Auth0. Payment processing is handled by Stripe. Both are subject to their respective privacy policies.

11. Service Availability

We aim to maintain high availability but do not guarantee uninterrupted access to the Service. We may perform scheduled maintenance, deploy updates, or experience outages beyond our control. We are not liable for any loss or damage resulting from service interruptions.

12. Limitation of Liability

To the maximum extent permitted by law, gener8v shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising out of or related to your use of the Service. Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim.

13. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

14. Indemnification

You agree to indemnify and hold harmless gener8v and its officers, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

15. Modifications to Terms

We may update these Terms from time to time. Material changes will be communicated via email or through the Service. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

16. Termination

Either party may terminate this agreement at any time. You may terminate by canceling your subscription and ceasing use of the Service. We may terminate or suspend your access for violation of these Terms, non-payment, or any reason with reasonable notice.

Upon termination, your API key will be deactivated. Provisions that by their nature should survive termination will remain in effect.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
